Settlement at Judicial Mediation

GC Story 


In November 2018 I was accused of Sexual Harassment towards a colleague. Despite being absolved of any wrong-doing in April 2019, my employer took an unprecedented step of reopening the case in June 2019. I was eventually cleared again in July 2020, but my employer continued to pursue me for a breach in Standards of Behaviour. 


Despite acknowledging both investigations were flawed, my employer made no attempt to hold anyone accountable.  In August 2020, with no resolution in sight, I ended up taking sick leave, and I was diagnosed with cPTSD a year later.


Eventually, in November 2021, a manager declared the reinvestigation of the case was unlawful/unnecessary, and the original decision of 2019 was reinstated.  Whilst this was a welcomed relief, it was of no real satisfaction. I had been under investigation for 3 years, been the subject of gossip and conjecture, subjected to offensive and spurious statements by colleagues and managers, had my career eroded and my home/social life upended. 


Disappointingly, my employer still had no remedy for the treatment I had endured, and even more frustrating was HR’s refusal to accept I had been harassed during this period. 


My journey towards a resolution began with a submission to an Employment Tribunal in November 2021. Whilst that Tribunal was never realised, John Nixon and team helped me achieve a sizeable settlement at Judicial Mediation in November 2023.


During my time working with them, I was encouraged to take an active role in the case. As such, I felt totally in control of direction under the team’s guidance. What was particularly useful was two of the team had experience working within this sector, so had a real grasp of policy, procedures and internal workings.


Going through the Tribunal process was stressful, exhausting and sometimes utterly frustrating. So, what I found particularly comforting was every now and then someone from the [MyLegalCase-] Employment team would just call to see how I was.
